It is a fact that a Staggering 50.9% of long term absence is attributed to stress. More and more employers are recognising that an EAP (*Telephone stress helpline and face to face counselling) can not only help to reduce episodes associated to absence in the work place, but will also demonstrate a duty of care.

An EAP may mitigate liability, should an employee seek to pursue a personal injury claim against an employer, associated with work related stress. There is strong case law which would suggest that if an Employee Assistance Programme is well publicised and used, it is unlikely that an employer will be found to be in breach of their duty of care (Lady Justice Hale - Court of Appeal, February 2002)
